
Podcast Guest Terms & Conditions

These terms apply to any individual appearing as a Guest on the Sink and Swim Podcast (“Event”), hosted by Dr. Julie Granger, DPT of Illuminate Freedom Coaching & Education (“Host”). By participating as a Guest (“Guest”), the Guest agrees to the following terms:
1. Guest Expectations, Responsibilities & Services
The Guest agrees to participate as a Guest Expert and provide an Interview for the Event under the following expectations, responsibilities, and services:

a. Interview.
The Guest agrees to share their knowledge and expertise with the Interview Host in an interview approximately 70–90 minutes in length. The Interview will be recorded and aired later by video/audio on an ongoing basis across all podcast hosting platforms and in clips on pertinent social media platforms.

Content and Topic. The topics and content of the Episode will be determined by the Interview Host on or by the date that the Interview is shared publicly.

Title. The Title of the Episode will be determined by the Interview Host on or by the date that the Interview is shared publicly.

Recording. If the Interview is videotaped and/or audio recorded by the Interview Host, whether live or pre-recorded, the Guest consents to the use of their voice and likeness in such recordings.

Interview Materials. The Guest agrees to complete the Podcast Intake Form and provide any other pertinent intake data via the electronic platforms specified by the Interview Host no later than 3 days prior to the Interview. The Interview Host reserves the right to choose what from the intake form will be used in the Interview. Any topics denoted as off limits by the Guest will be honored by the Interview Host.
b. Marketing and Promotion.
The Guest agrees to use only published podcast links/platforms to promote the Interview and agrees to use the published title and topics to describe the Interview, making reference or linking back to the Interview Host and their platforms.

c. Links and Headshot.
The Guest agrees to provide a headshot and any pertinent website links for inclusion in the show notes at least 3 days prior to the Interview, as requested via the Podcast Intake Form.
2. Interview Host’s Responsibilities.
The Interview Host agrees to organize the logistics for the Interview, including:

a. Audio/Visual Logistics.
The Interview Host will provide backend coordination and production for the Interview, including the Event sales page, Interview logistics, setup, video/audio recording platform, conference call lines, and replay links for video/audio recordings shared with the audience.

b. Promotion of Guest Expert.
The Interview Host will promote and market the Interview before and on the day of release, including the Guest’s name, title, and headshot, and may include any content from the Interview or Podcast Intake Form. Reasonable efforts will be made to promote and encourage listenership.

c. Replay Link & Recording.
If recorded, the Interview Host reserves the right to share the replay link and recording with the audience for a limited time and/or for promotional or marketing purposes. The Guest will not be provided with a copy or link to the full video, audio, or clipped files for personal use, websites, or other purposes.
3. Compensation.
The Guest agrees to provide the Interview without compensation and will not request compensation from the Interview Host at any time following the Interview. In exchange, the Guest may receive mutually beneficial marketing and exposure to the Interview Host’s audience.

4. Cancellation or Rescheduling of the Interview or Event.
If either party needs to reschedule or cancel the Interview or Event, best efforts will be made to notify the other party via email prior to the scheduled time, barring accidents, weather, acts of God, or illness. If a reschedule is needed, the Guest agrees to reschedule as soon as possible to allow for timely recording and airing.

5. Intellectual Property.
a. The information, knowledge, and subject matter shared by the Guest remain the sole intellectual property of the Guest.
b. The Guest grants the Interview Host a full license to use episode materials (clips, full video/audio) for marketing, promotional, and business purposes.
c. The Guest agrees not to reproduce, duplicate, copy, sell, trade, resell, or exploit for personal or commercial purposes any podcast materials produced by the Interview Host.
d. The Interview Host may add their logo to audio/visual materials or clips.
e. The Guest grants the Interview Host full ownership and intellectual property rights to any video/audio recordings and transcripts. The Interview Host may repurpose, resell, or reuse these recordings indefinitely without compensating the Guest, and will identify the Guest by name and title.
f. No other intellectual property rights are granted to the Guest beyond what is outlined in these terms.
6. Media Release.
The guest consents to the participation in, and grants the Interview Host full rights to the use of the Guest’s name, image, likeness and/or voice in video and/or audio recordings, marketing materials, social media posts, blog posts, e newsletters, and any other means that contains photos, images, or references to me that is recorded or shared during before, during or after the release of the Podcast episode, at the sole and full discretion of the Interview Host. The Guest agrees to waive any rights of ownership or copyright in the podcast episode materials created by the Interview Host and grants the Interview Host authorization to use these podcast episode materials indefinitely, recognizing that all such media solely is the property of the Interview Host. The Guest acknowledges that no financial compensation is provided in exchange for waiving these rights.
7. Disclaimer, Assumption of Risk, Personal Responsibility, Release of Claims.
Care has been taken in preparing this Interview; however, the Interview Host cannot be held responsible for any actions, errors or omissions and accepts no liability for any loss or damage related to the Interview, promotional period, or podcast episode release.
The Guest takes full responsibility for their actions and information before, during and after the Interview, promotional period, and podcast episode release, assumes all of the risks related to the Interview, promotional period, and podcast episode release, whether or not such risks were created or exacerbated by the Interview, promotional period, and podcast episode release. The Guest fully and completely releases the Interview Host, his/her heirs, executors, administrators and assigns, officers, directors, shareholders, employees, teachers, lecturers, agents, virtual assistants, and any other staff or team members of the Interview Host (collectively, the “Releasees”) from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, against the Releasees, that the Guest may have had, now claim to have, or might possibly claim have in the future, arising from the Guest’s participation in the Interview, promotional period, and podcast episode release.

8. Choice of Law, Arbitration and Limited Remedies.
This Agreement shall be construed according to the laws of the State of North Carolina, where the Interview Host’s business is based. In the event a dispute were to arise between us, either arising from the Interview, the podcast episode release, or the promotional period, the Guest agrees that binding arbitration before a sole arbitrator in accordance with the rules of the American Arbitration Association is the sole legal remedy that may be used. Any judgment rendered by the arbitrator may be entered in any court having proper jurisdiction. The prevailing party shall be entitled to all reasonable attorneys’ fees and all costs necessary to enforce the decision of the arbitrator. The Guest agrees to not engage in any conduct or communications, public or private, including on social media, that disparages the Interview, Interview Host and his/her owners, officers, directors, staff or team members, employees, or agents. Where requested by law or arbitration, the Guest understands that the Guest is not prohibited from sharing their thoughts and opinions as a part of the legal process.

9. Independent Contractor Relationship.
The Guest understands that by providing the Interview, the Guest is not in any way becoming or considered an employee, partner, agent, or joint venturer with the Interview Host for any purpose. The Guest shall have no claim against the Interview Host for benefits attributed to employees, including but not limited to compensation, vacation pay, sick leave, retirement benefits, social security, worker’s compensation, health or disability benefits, unemployment insurance benefits, or employee benefits of any kind.
